    Cell Phone Spying - Scary Situation & Question?
    I have a very paranoid and odd question and don't know where to start. I'll try and abridge the situation and then move on to the question without making it complicated.Almost a year ago a friend of mine became involved in a legal case that involved a private investigator and one of his employees. The PI, the owner of the company, was a neutral party and a personal friend of my buddy's. My buddy and the PI's employee became involved legally over an incident that had nothing to do with business and was purely personal. Long story short, the PI got tangled up between the two feuding parties and decided to help mediate the situation. He called my buddy one night and began reading the text messages from my buddy's personal cell phone. He also had access to her call log and the date/time of each call. This guy then did the same thing to me - he read my text messages to me over the phone and also my call log. This may sound strange, but neither my friend nor myself thought to ask how or why he had access to such information at the time, and not long after the PI died of a heart attack.

    Fast forward, the feuding employee of said PI bragged to many people that he had copied the contents of the PI's hard drives after his death. He then began harassing my friend and she put documentation together to file an anti-harassment (restraining) order against this employee. On the day that she went down to the courthouse to file the order and go before the judge and get a temporary order, the harassing employee showed up at the courthouse for the initial hearing! Needless to say she was shocked and scared at the same time.

    For those of you not familiar with how the process works for filing a restraining order, when you file for the order you go before the judge that same day and (usually) a 14-day temporary order goes into effect. Then, the defendant is served by a sheriff's deputy and notified that there is a temporary order in effect against that person and that they can show up at the hearing in two weeks if they wish to fight it. It's very, very rare for a defendant to know when a petitioner is filing for an order and the exact day when he/she is going to go to the courthouse and actually file it. In my friend's case, this means that this employee was tracking her activities.

    Now, my friend and I concluded that the only way that this guy would have known she was filing was through text messages which were sent between her and I. She sent me a text message stating that she was going before the judge at 3pm and this idiot showed up. She was freaking out when he showed up, and she doesn't want him to be able to track her text messages going forward.

    As I understand it, to be able to monitor someone's cell phone, the monitoring person needs to physically install software on the cell phone of the person that is being monitored. Software such as Mobile Spy and FlexiSpy are well known, but again they require a physical install. My friend bought a new phone after she broke contact with the offending employee and has not been near him since. I certainly hadn't been near either the PI when he was alive nor have I ever met this creepy employee of his.

    So, is it possible to monitor someone's cell phone without actually installing special software on the phone being monitored? How would someone be able to do this?

    Finally, what can be done to prove that someone is illegally monitoring someone's phone in this manner?

    This is a scary situation and both of us are very nervous. I understand that it is illegal for someone to monitor someone else's phone without their consent or a legally written court order. It must be said that the employee of the PI is not in fact a licensed PI himself and should not have access to these tools. However, with him bragging that he stole the contents of his employer's hard drive after he died then it's possible that he now has PI credentials which he is feloniously using for his own benefit.
